Default ITIN info please

Hi,
I am getting my wife, mid of next month. In order to include her name in the my next year tax returns, what is the procedure ?
What is ITIN ? Where (which office) should apply this ? Can I apply for this as soon as I come back ? (I will be informing our HR department regarding her arrival)
Any info regarding this will be helpful

Thanks
Naveen

Default Itin

Naveen,

As per the revised rules for ITIN, this number can be obtained only if Form W7 is completed and filed along with tax forms (1040). So you can wait till you get 2004 W2(s) and other income details. Then you can file Form 1040 and Form W7 before April 15, 2005.

Default Getting ITIN no. - Very easy

Actually you dont have to wait till you get your W-2s.

My parents are here on Visitor's visa and I have applied ITIN no. for them so that I can file them as my dependent when I do my taxes for 2004.

You will need to file the papers with Form W-7 and your wife's passport copies of all the paers. Make sure you get the passport copies of all the pages "Notarized" This is very important. IRS wont process your ITIN no. untill they have notorized passport copies of all the pages.

With this process you should get ITIN no. from IRS within 4 to 6 weeks.
Let me know if you have any questions.
Thanks.

Default Itin More Info Required

Hi,

I have just received my W2 Form for last year. I also need to apply for an ITIN no for my wife (H4). As per the IRS site, the W7 shoud accompy with federal tax return and docs. I am confused abt the filing of Federal Tax Return, As my wife is on H4 how can she apply for tax return?? Or Does Federal Tax Return here refers to my Tax Return that I need to send along with W7? Or my wife needs to file her own Tax Return stating income as Nil. 7Also Which Form (Tax Return) does she need to fill and send along with W7.

I tried checking for Frm 1040 but am not getting the form on IRS site, wud appreciate if someone can send me link to From 1040 or the form that my wife needs to submit along with W7.

Also do I need to wait fro the ITIN no before I can file my tax returns???
Awaiting replies.

Default W-7 form

The w7 form is available at this link.

http://www.irs.gov/pub/irs-pdf/fw7.pdf

You just need to fill out the form W-7, attach notarised copy of any two documents preferably your wife's state ID and passport visa page with I-94 card and send it out,(address is in the form),It should take about 4-6 weeks. When you get the number, you both are going to file taxes as "Married filing jointly" .In the place of SSN for your wife you will have to put her ITIN no. thats it.Dont worry.Hope this helps!

As earlier posts say,you don't need to have your current W2 form in hand to apply for her ITIN.

Hello Samuel,Saras and all,

i got stuck in 6c section of W7 form.
6c is about Visa Number , experiation number.

My Visa on passport is expired, and needs revalidation to match up with the new approval ( FORM 797 ) which is not expired yet.

What do i need to fill in there ? Visa Number from passport leaf or the SRC number from I-797 FORM ?

If Visa number, then , i dont find any description called VISA number .
where would i find that ?
and to avoid confusion for them should i write SRC number with Valid Expiration ,instead of Visa number with Expired Date ?

Thanks in Adv
Sanjay

Hi All,
This is no legal advise.

for w7 you should have pasport first , last, visa and i94 copies - all papers notarized. Add other notarized papers if visa expired etc.
w7 can only be submitted along with tax returns with the changed rules.
tax returns would have the names of the people who you are claiming as dependants, and then their affidavit about their stay in usa (if first year choice). Thus you would be either filing a married joint return OR head of household status
And while doing either of the above, you cannot efile. Only paper return.

Hope this helps.

Can we claim our parents who are visting from India as dependents on our tax return? I saw an earlier post in this thread (by Neo2005) that he/she applied for ITIN for the parents. I did not find any valid statements in IRS website that proves we can claim visitors. Any suggetions? Thanks in advance
