Question H1B Visa expiry close to Baby's Delivery Date

Hi,
I am on H1B status and my Wife is on H4 Status. I would be completing my 6yrs term next january. We have already made plans to return to India for good. (Have not filed labor for GC).

Now my question is, we are expecting our 3rd kid around mid-december this year. Since the delivery date is pretty close to my Visa expiry date. What happens if i am unable to get the new-Born's papers (Passport/PIO etc..) before my visa expires?

I am confused and could not find an answer anyplace?. Could someone reply ASAP, and i can plan accordingly??

u can file extension of h1/h4 status by recapturing time spent outside US. this can give u a few more mnths of valid status to live in the US. please check with ur company attorney

Thanks for your reply Ron. But the term-end of Jan'07 i mentioned includes my time outside US (6wks in total).

please consult with an immig attorney to determine the options available.
US passport /ss for child can take abt 3-6 weeks. for travel to India u may get an emergency travel doc- please contct the indian consulate.
