View Full Version : Need UrgenHelp for VisitorVisaExtension Case -- Its a Special case

Hi Group, I applied for my mother Visitor Visa Extension its almost 1 1/2 month we didn't hear anything from INS, my mother needed urgently to leave for India, her visa is 10 years multiple visa, we are verymuch worrying ,if she wants to come to US in Future does she gets anyproblems , we kept all documentation ready like, extn receipt,her 1-94 etc etc.
its almost 2months she lived here after expiring her i-94. can anyone help our case.
does anyone faced simar case and did ur parents allowed to US again later without anyproblem or does they have problems, pls share the experience it will be very mcuh helpful.

Did you apply for your mom's extension after her I 94 expired? Becoz you say she has stayed over 2 months after her I 94 expiry and you also say that you applied for extension 1 1/2 months back.

Yes, i have applied for my mother's extension before i-94 expires, her exten application received date is Oct 14th,we got the recipt too, and I-94 expired on Oct25.,

Hi
It seems you are having the acknoldgement receipt from INS. Take a xerox copy and keep it with you and attach the original with your mom's passport for handing over the same to Airport authorities at her departure from US.The airport authorities will separate the same from the passport and keep it with them for their records.It will solve your immediate problem.Later on when you receive the Extension Letter you send the same to your mother she can show the same to airport authorities when she arrives next time to USA

She can leave without any problems. Make copies of her I94 and keep records of her extension paperwork. From the dates you mention seems to me she is in present in US legally.

Sorry I didn't get you......she has applied but not yet recieved the approval right?

Well you are save and sound if she recieves the extension. Incase her extension is rejected then I think her stay from Oct 26th until she leaves US becomes and illegal stay. Correct me if I am wrong.

If you have recieved the approval good. Else pray for the best.

It is best she leaves before the reply for the extension petition arrives. Like Sonujan says, it is always good to have a clean record.
