View Full Version : B1 to H1 & now Visitor for mom

Hi all & Murali,

I want my mother to apply for visitor's visa but not sure how. Please advice me on the following situation.I will try to explain in steps

1.I came USA on business visa in sep 03
2.Got H1 approval in December 03 (never went to India to get it stamped) for 3 years
3.My mom, dad and younger sister applied visitor's visa in June'04 for my wedding which was REJECTED. My husband sponsored for their visa because we thought since he has stable income they would grant the visa. They rejected the visa after seeing my passport that I came here on business visa and got transferred to H1 and never went back home. OR may be they thought I am illegal here. They never gave any reason of rejection.

Now I want to sponsor just my mom because I have stable income to show to consulate and to show I am legal here.

But my confusion is which bet is safer
Me sponsoring my mom OR my mom coming on her own without sponsorship.

Any help would be appreciated.

If she can show enough funds she can just apply on her own, it is a simpler case since she will not have to show any docs from you. She will have to mention your details in the application.

Hi!
Your mom can sponser her own trip if you can show enough funds in India. Also don't understand why they would think you are illegal? Did you not send your H1B approval notice?

I did send my approval notice & I94. But for them it was odd for me to get B1 to H1, hence rejected. But I really appreciate your reply. thank u.
