Hi

I attended an interview for H1B visa at chennai consulate on 8th October 2003 and the consular officer was refused to give visa since he conducted technical interview for me and i was unable to answer the questions he posed to me.

He served me a letter stating that my visa is denied under section 221g and in addition to that he recommended INS to suspend my petition (I -797). He took all my original documents pertaining to the pertition namely, I-797, I -129, LCA & A letter sent by my U.S. employer to INS while filing the petition.

He also took my copies of degree certificates and transcripts alongwith the experience letter (Issued by my Indian employer) and put a stamp on the passport saying that "application received".

Can anyone tell remedy for this?

As per the letter what i understand was, i'm not eligible to enter U.S. forever.

Can anyone post their opinions in this regard?

What technical qns. did he asked??

If he asked INS to revoked your petition, this mean you are screwed man.....

Whats up with these technical question. did u have an IT degree? What technical questions did he ask.

I did my master's degree in Microprocessors from Nagarjuna University in the year 1987. I have got the H1B approval based on JAVA & C & C++.

After knowing the above skill set of mine the consular officer at chennai conducted a technical interview means the basics of the JAVA,C & C++. I have answered 50% of his questions and after that the consular officer brought a book which contains the deep concepts of java
namely, EJB, CORBA, RMI, etc. and some difficult questions in C++.

I couldn't answer the questions that he had posed to me and was totally out. Then he told me that he is sending all the originals to INS and asking them to suspend my petition. I couldn't do anything except listening to him.

So can anybody tell what is the serious implication for this type of refusal?

1. Am I eligible to reapply to INS for H1B in the future?

2. If I have been selected through some good company to go to U.S. will the consular officer consider my case again?

Can anybody through some light on this?

My sincere advise to friends that everybody should prepare for technical interview also according to their skills set.

Was this happened at Chennai Consulate? Was the person was american or Indian assistant?

This seems to be bullshit to me?? consular brought the programming book & start asking qns. from the book.

Did he went to get a book & ask you to wait till he come back? or he was having the book with him in the 1st stage?

Applicants are ineligible under Section 221(g) because some document or information, such as an Certificate of Eligibility for Nonimmigrant Student Status (I-20), SEVIS confirmation, or a valid passport, is missing. If you are ineligible under Section 221(g), we will give you a green ineligibility letter or pink ineligibility letter, listing what is needed and explaining how to reapply. Follow the instructions carefully and re-submit your visa application.

Dear Consular,

This was a fact and it was happened to me at chennai consulate. He is an american not an indian.

After asking some basic questions, he went inside, brought a book and started asking questions. It took nearly 15 minutes and all the time i was standing at the counter only. Finally he told that he will recommend the INS to suspend my petition and served me a letter against section 221g my visa was refused. He also told that some body will come and talk to me. I thought he may be sending the papers for verification and genuinity.
I waited there for nearly 5 1/2 hours and finally at 4 p.m. a non-executive staff called me to the counter and he took all my original documents pertaining to my h1b petition alongwith my copies of degree certificates and transcripts and given me 221g letter.

I was totally surprised about this incident.
