I read online that if a visitor applies for an extension and say the request gets denied, if the visitor stays past the original I-94 date, the 10 year Visa basically is voided.

Was anybody's family memembers encountered that situation?? I just filed for my moms extension for 3 months, the USCIS site says its taking 100-150 days for a decision.

So filing an extension looks like is kind of risky.

Also is there a website where one can check if their visa is valid or not ??

Thanks

I have read that on some forum but I don't think it is true. Not sure what the law actually is.

Generally when you apply for an extension , if the petition is rejected you go out of status immediately so you have to leave the country right away.

Ladies and Gents

My mom received her extension approval on Dec 28th, I filed for her extension on Nov 17th. When I picked up the mail I was kind of nervous and as soon as I opened, all I was focussed is the bottom left hand portion of the letter. Praise God!! it all worked out.

I checked the case status couple of times in the past month and the website always mentioned its taking between 100-150 days. I thought I mite not hear from USCIS before my mom left, as I only requested for a 3 month extension.

I am glad it all worked out, but I wish the sweet news made it before christmas, I guess Santa was too busy ;)
