View Full Version : Chennai consulate asks for proof of I-94

Hi

My in-law had visa rejection Y-day from Chennai consulate.

Background.

First time visa was granted from 31-jul-2002 to 29-jul-2003 for both of my in-laws (Dad/Mom).

My Mother in law had come to US on Oct 20, 2002 and after an extension of visa which was approved, she stayed till Oct 2 2003 which is well before the expiration of visa extenssion.

My Father in law had come in April 7th 2003 and he went along with my mother in law on Oct 2 2003.

In my father in laws case, he stayed till Oct 2 2003 based on the stamp on the I-94 which was stamped for 6 monthes from the time he arrived. So his stay was under the legal limits.

Current situation:
When they applied together for a visa the consular was fine with the extension document we provided for my mother in law. But he said my father in law over stayed and he was asking for proof for the same. The only proof in this case is the stamping on I-94 document which he had to trun back in at the time of his departure at on Oct 2 2003.


Question is how can we get a copy of the same I-94 card so that it can be used for applying for the visa next time. If any of you have gone through a case like this please share your thoughts.

Please see your father-in-law's Passport definitely there will be US Immigration stamping of his arrival date somewhere in the Passport. Good Luck

It is always advisable to take a photo copy of the I94.
You may find how to get a copy from USCIS by calling USCIS support line,
Also, by any chnace do u have thier Bording pass counter slips ? for their last return journy? if yes that would help as a proof of return.

Departure stamp is already there in the passport, but the consular did not accept that. All he repeated was that my in-laws overstayed which is not the case.

I have the copy of one side of I-94, but the other side has the time stamp.
Well, do you know how to request a copy fo I-94 from the agency you had indicated?
Please share your thoughts on this.
