View Full Version : H1B refused under 221g. Please guide

I have appeard for H1B in chennai last week. The visa officer refused my visa and marked more than 10 documents to provide under 221g. My US employer is surprised that nobody got so much queries and said that they will provide the required documents and it will take nearly 15-20 days. I request the experienced members to please help me in the following :
1. What the consular going to ask in case of 221g refusal if we appear again.
2. The delay in reappearing will have any problem in the consulate.
3. Did anybody got so much queries.
Please help me. I will be thankful for your replies.

Some cases are refused under section 221g. INA and requested to return with additional information to assist in the adjudication. Persons refused under section 221g INA will be given a form letter explaining what additional information is needed and when to reappear before the consular officer. These applicants do not have to pay another application fee.

I have been given form requesting more than 10 additional documents from my US employer.
My worry is did anybody got so much additional documents request.
Please share your views if anybody has faced such an issue.

Hi,
If the consular officer asks more documents, it means that he is not convinced that the company is going to pay you in accordance with the law and provide you with work. You will have to overcome these assumptions by good documents, which will include most of the documents marked on the 221(g) refusal notice given to you.

I know so many people who got the 221(g) refusal, they have been asked 20 additional documents. Its becasue of consular officer is not convinced with the answers you provided. When you are going for the next interview with the additional documents asked by Consular officer be confident when you are answering the queries. You answers should convinced consular officer.

Your suggestion will definitely help me. As Veena said the Consular is not conviced with the pay package, I agree because my pay is just above the min. wage in US.
I am waiting for the documents from my employer.

My Employer has not given me the documents yet (replies to 221(g)). Its almost 5 months since I attended the interview for the first time. Every time I call they are saying its under preparation.
Did anybody faced such situation ?

U dais you got ur H1B refused under 221g.were u been given a blue sheet or white sheet.Did they ask you to come again.

I have seen people getting back to the consulate after 2 months after getting 221(g) refusal. In half of the cases I knew, nothing was asked. But, in your case, since its 5 months, better be prepared for an appropriate answer for the delay. Also, make sure that you carry new DS 156 and DS 157 with the latest information. I heard that we should carry a new DS 156 and DS 157 even in case of refusals.
