Hi,

I have a strange case. I work in U.S. I worked for employer x until 10th August, but visa for the company x was stamped on 18th August. This visa is valid until 2006. Later I moved to employer y.

Now I am willing to travel to India and back without stamping. Can I do that, with new 1-797 approval ? Since VISA is "independent" of the company, I think I can do that ? Are counsellors so thorough.

What happens when you are debarrded from port of entry ? Can I get emergency appointment ?

Should I be worried, anybody has any experience

I want to add that I had sent for stamping before leaving company x, but I recieved the passport with stamping after I had left company x and joined company y. This is not my problem, this was because ealier the stamping in U.S used to take 3 months.

Therefore the stamping date on the passport in name of company x, is after I had resigned company x

It can be though argued, that later after joining company y, I may want to comeback to company x.

Please somebody reply !!!!!!! Is the stamped visa valid for travel ? if it is not why ?

Under ac21, u can re-enter with valid H1B visa from old company - make sure u have both I797's at POE - Also u shld request new petition validity dates on I94 - Note that I94 determines status in the US.
However inorder to take benefit of AC21, u must have filed for the h1 transfer while u were in valid H1B status (valid i94 of previous employer)
