View Full Version : Urgent Help - H1 Transfer

I am working for a company A and I am on their H1 from Oct 2004. Now I got a fulltime offer from company B.

I am getting married in Nov 2005 and I am planning to go to India and I will be back on end of Dec 2005.

I have 2 questions -

1) If I get my new H1 approved, would my old H1 be automatically cancelled? or does my company A should revoke my H1 manually?

2) Visa Stamping dates are not available in India right now till feb 2006. If my new H1 gets approved, can I go in old H1 and come back and change my H1?

Please advise.

1. when you transfer the Hq old H1 also remain valid Unless it expired or cancelled .

2. For going out of usa , you dont have to show any proff of H1, it is required while entering into USA, so f you have a old valid H1 satmp and a new approved visa petition you should be able to enter based on exisiting stamp , but sow the new H1 approval at the POE.

Thanks for the reply Murali.

Is there anyway I can track whether my visa is active or cancelled.

My current company is American company, so I am not sure whether they will cancel my visa once I give my 2 weeks notice before I go to India.

What would be the best thing to do to avoid this confusion? Please advise.
