Urgent: Transfer and Extension togehter ?

Urgent query for a friend.
His H1 visa is expiring on 15 December 05. He has not yet applied for extension. He wants to change company.
Can he extend and transfer at the same time through his new company ?

Please reply urgently.

If your friend changes his job, he (his new employer) can apply for his premium H1.

I suggest your friend to wait till his visa get extend and then transfer to New company. I don't think he can do both the things at the same time. Take an attorney advise on this and then take the decision.

Actually my friend has already resigned from his current company and would be joining new company in two weeks.
Ronald, can you tell me in more details why exactly he should first extend and transfer ?

I am not sure how your friend can start working at the new company with out the H1B transfer. He is legally not allowed to work for the new company without proper work authorization

Hi,
If he is already working in the US on a H1 for Co.A, he can start working for Co.B if the Co.B has only filed for his H1B transfer. This is called portability provision.
