After 5 years of L1, can I come back on H1 or B1 immediately

Hi,

If my L1 visa expires after a 5 year stay in US, the rule says I need to go back. Can my company send me back immediately on H1 or B1? Or should I wait for minimum 1 year to come back to US on any visa?? Please let me know.

u can file change of status petition for h1 while u are in the US.
If the the COS petition is approved u can get an additional year of stay (h1 term is for 6 years - includes time spent on l1 visa)
Note that the new h1 is subject to cap.

Thanks Ronline......what about B1 visa? Will I be allowed to travel or should I wait for 1 year?

u can travel on b1 anytime - (time spent on h1/l1 does not affect b1) please contact ur company attorney for more info
