I am on H1 , but presently not working since October 2003 becuase company is making new set up and still it will take still almost three months to start.

Now some one is opening new company and want to appoint me. Now my question is:

1. Can I get transfer of H1 where I will be only one employee in this company becuase this is new company.
2. I do have only pay slip for the month of October 2003. Will it be accepted for H1 transfer.
3. I do not understand the difference of H1 transfer and new H1. becuase here we also suppose to pay $1000.00 extra for fast processing like in new H1.
4. company is appointing me in Wyoming and company office is in California. I do not understand where company will apply for H1 and for Green card.

1) Yes, thoguh its up to the BCIS to decide after making sure the case is genuine.
2) That should not be big problem and the lawyer handling your case should be able to prepare the case.
3.) The prcoess is same but in case of transfer the H1 is not against the H1 yearly Quota.
4) Leave this on the lawyer who prepare your case, he/she would do accoding to law and allowed.
