View Full Version : Parents have interview : I have changed H4 to H1B...not stamped yet ?

My parents have visa interview in Sep.
In april i have got my H1 approved(Oct 2005). But H1 is not stamped yet.
1. Will the cosulate come to know about my changed status H4 to H1 ?
2. What should i fill in DS-156 form about my status...that i am on H1 or H4 ?
3. Since i will have to send a copy of my passport .....and in case i have to write my status as H1 on Ds-156 form ...should i need to send a copy of my H1 approval ? Waht else do i need to send ?
4. Will this create any problem ..as my passport is not stamped yet ? or me changing from H4 to H1.

If you have already changed the status from H4 to H1 you are on H1.
Send a copy of your H1 approval also along with all other documents. do not worry abt the visa stamp in passport, Visa stamp and Legal status can be 2 different things.

Thanks for the reply.

My H1B was approved in April but i can legally work from Oct 2005. So am I not on H4 till Sep 30 2005.
I do have my H1 approval so sending it ia not a problem.I just do not want to fill wrong data or send uncessary confusing documents.

Yes, you can fill status as H4, but stil sent the H1 approval copy "only in case asked" .
