View Full Version : Visiting Canada While Visiting USA

Hi,

My parents are here in US for little over 2 months. They have a 10-yr multiple entry US visa and they obtained 6 month stamp when they entered US. Next month they plan to visit Canada for 5 weeks. They have obtained a valid Canadian visitor visa.

I would like my parents to stay longer than 6 months. So I am thinking of applying for an extension. When they return back to US from Canada, it will be 4.5 months since they first entered US. When they enter US again, will they get a 6-month stamp automatically starting from their date of re-entry? In that case I don't need to apply for extension as they have extra 6 months. Is it OK to wait until they return back from Canada (about 4.5 months after their first entry in US) to apply for extension?

Each time to enter into USA, you get a new I94 and new dates for vlaid stay, so when your panrents enters back into USA from Canada they will get a new I94.
The validity may be 6 months from that day, dpends on the oficer at the POE, but in most of the cases it would be 6 months.
In my opinion , you should not apply for extension if they have plan to go to Canada and come back.

They will not get another I-94 as they are not coming from their home country . They will be asked to go to India and then return to get another I-94

Normally when they leave US, isn't their I-94 taken back? If they will not be issued an I-94 on re-entry from Canada, will they be able to enter US? If yes, how long will they be able to stay? And if they are not allowed back, what are my alternatives?
