Hope some one can answer my question....

I have valid US visa on my passport till July 2007. However my passport is valid till April 2005. So my question is... when I re-enter into US, will the immigration officer issues a new I-94 valid till April 2005 (i.e based on Passport's validity) or July 2007 (based on Visa validity)?

If they give I-94 based on Passport's validity, how can one renew I-94 without visiting abroad?

I got the info. Just posting to help others.

There are 2 kinds of forms.

1) I-102 + $155

ADVISORY: Do not use this form to request an action on a Form I-94 issued by the Bureau of Customs and Border Protection (CBP). If you are seeking a new Form I-94 based on a Form I-94 issued at a port-of-entry or otherwise by the CBP, you should contact the nearest CBP office or port-of-entry and inquire about their procedures, or visit that Bureau's website at www.cbp.gov.

2) I-539 + $195 --- To extend original I-94 (valid for most of non-immigrant applicants)

Q: How do I apply to extend the period of time that I am allowed to stay in the United States or change my current visa classification in the United States?

A: If you wish to extend your authorized period of stay in the United States or change your nonimmigrant status (visa classification), you will need to file an Application to Extend /Change Nonimmigrant Status (I-539 Form) with USCIS. You will be asked to submit your original I-94 Form upon filing the application.

If you were not given an I-94 Form when you were legally admitted to the United States, please file an I-102 Form. You will need to provide USCIS proof that you were legally admitted to the United States. You should file the I-102 Form at the same time you apply to extend your stay in the United States or change your immigrant status.

Before filling I-539, try going to any nearby nearby international airport and talk to CBP and get extended for FREE. If not, those who are staing in bay area may visit Tijuana to get new I-94 for $6. Ofcourse, you may have to travel to Tijuana. Otherwsie, Pay $195 and get new I-94. Choice is yours.

I94 can be issued with a date equal to the visa expiry date even if the passport expires before that.
Visas/i94 stamps on expired passports are still valid thru their expiry date.

No'op. I can't believe this since logically does not make much sense to me.

Passport is the legal doc for an alien. If that expires, I-94 can't stand there. Menaing it's TOTALLY illogical to have I-94 without a valid passport. Who knows Indian Govt may refuse to extend the passport? If so, do you think that US Govt allow us to stay in US?

Anyway, if they don't notice then they will issue I-94 based on Visa validity. If at all they issue that means the immigration officer is unknowingly making mistake.

Anyway, I know how how to extend Passport and I-94 within US.
