Hi,

I have valid H1b for the company A. I have not travelled on that due to the recession.Now I am planning to go to USA in near term.

Could please advice me on following :

1.Is it possible to extend it and transfer the visa to other company say B from india.
2.My current employer is interested in extending the H1B.Is it good option to extend the visa or apply for new visa as 3 years are already wasted without using it.

H-1B extension cannot be done in your case, as you have not worked for the sponsored employer so far.

But new H-1b petition can be filed by a prospective employer under a non cap case.


2.My current employer is interested in extending the H1B.Is it good option to extend the visa or apply for new visa as 3 years are already wasted without using it.

You current employer cannot extend the H-1b unless you worked for him in US and paid the US taxes.

This means that I have to find the new employer before my visa gets expired .

You can find a prospective employer to file your H-1b under non cap case. There is no time limit for it.
