View Full Version : Need advice on a tourist coming to US again after just a two months stay outside.

Hello All,
My mother was here for two months (may, june) and she is planning to come back in September. Is it okay if she comes back as a tourist without a 6 months gap, considering that she wasn'y here for the full 6 months on her last visit. Do they question her at the port of entry and may deny her entry? Please advice.

It would depend on factors like How long she plans to stay and more importantly, if she has a good enough reason to return so soon.

The likely questions I expect at the POE:
1. Why did you not stayed for full validity period in earlier visit (If she is granted 6 months stay but left in two months)
2. What prompted you to come back for visit within 3 months time?
The CBP officers will definitely try to know the intentions behind this quick trip. If you can't show a justifiable reason, it would be a problematic for her to be admitted or if admitted the duration may be less than one will get normally other wise.

If she has multiple entry visa , she can legally entitled to enter into USA as many times as she wants However, the length of stay will be determine by the officer at POE, if there is a legitimate and convening reason Or if the officer is in good mood she can get another 6 months stay otherwise may get less.
(In general - in a given year a visitor visa holder can not get maximum of total 6 months stay...)

at POE wht minimum stamp of stay in usa they have means one month or less..

There is no set minimum days you can be granted on your entry. I guess it can range from 0 days (refused to enter) to 6 months!

Thank you all for your comments. Hopefully there won't be any issue at the POE and atleast they will grant a minimum of a month rather than refusing outright.

Yeah, I think so too. I doubt they'd outright refuse her entry...at the worst, she'd probably get a shorter stay on her I-94, but I feel it'll go well (its not like she stayed a full 6 months and is back so soon). Just prepare her to expect questions about her purpose of travelling so soon..
Also, my previous post was not meant to scare you, it was for the PP who wanted to know if there was a set minimum stay that can granted at POE!
