Parents revisiting US within 4 months

Hi All,

My parents came to US on Apr 15 2009. But my Father stayed in US for 15 days and left to India on Apr 29 2009. My mom is still here. So my father is planning to come to US to take my mom back to India. My father is planning to come in the first week of september 2009. Will there be any issues in the Port of entry? Can anyone please help me with this?

I assume he and your mother will be traveling before the I-94 date of your mother's entry. It is unlikely he would have a problem. Since his reason is to escort your mother home, the IO at the border will not find it to be an unreasonable entry. IO are judging the reason for the visit and the expected length of stay.

ya,my mother's I94 is expiring on Oct 14 2009...

At port of entry, if IO asks why he has come so soon, he can explain to IO that he has come to take back his wife to home country.He also should tell IO when he is planning to go back. Accordingly, he will be given a restricted stay in USA.Who knows he may be given 6 months stay also. It all depends on IO

First time when my father came, IO asked some questions:
IO: You are in the job and how can you stay here?
Father:I am on leave now
IO: If you are on leave how can you stay here for 6 months?
Father: I am returning back within 20 days so if you give me 20 days that should be fine. But my wife only stays here for 6 months
Io discussed with another officer and gave him 3 months,but my father returned within 20 days.
