Please .... Let me know answer for my question.

I came to USA on F1 visa stamping in DEC-2006 and successfully done my Masters in Electrical Engineering.

I got approved my H1-B visa in Masters Quota 2008-Oct, up to now (2009 March) i am on bench,my employer did not pay me.

He runned the pay-roll for November and December and he has given me the Original W2.

Now he is telling to go India to get stamping for H1-B visa, he will be prviding me all Documents for visa stamping, my intension is if i go with out client letter .i dont know what type of questions i have to face from VO.
My emloyer will be proving a Client (Fake) letter for me, he is telling that it depends on luck.

Now I decided that if apply for Change of Status from H1-B visa to F1 visa,I have I20 from University for summer May-2009.

After changing status from H1 to F1, now if i apply second time for H1 visa in April- 2010 , am i eligible to apply in Masters Quota or i can apply for Re-admission for H1.

After changing H1 to F1, i will be in F1 again, than after completing my first Semester, if i leave United states for some time (depending upon University rules) on F1 status, may i have get stamped for F1 visa again.

If so, after coming back to US, can i have a chance for Re-admission for my H1-B visa again or not.

Please Help me seniors, I am in a dilemma, to go India in this situation or shall i apply for change of status.

IF you are able to change from H1 to F1 and once you obtain the F1 status, you can apply again for F1 to H1 while remain in USA..
Else if you are already on H1 may not apply for a new H1, rather you should apply for a H1 transfer..
Consult an immigration lawyer to assess your situation and advise you the correct and easy way to handle this situation.
