I am currently in India with valid H1-B stamping. As I have some issues with my employer would like to apply for a new H1-B under non cap. My questions here is: Do I need to apply with regualr cap people(Apr 1st to 7th 2009) or can I apply any time?

--- Your new employer needs to apply for a H1B transfer which is always not subject to cap. That means you can apply for a transfer anytime of the year provided you have time on your H1b visa (6 year duration). But if you are planning to travel to the US, that can happen only after the approval of the H1B transfer (I-797 petition in hand) to the new employer.
