My wife is currently not working and I want her status to be back on H4. I know if we apply for I-539 we can get her back on to H1, once she was able to get job. My primary motive is to, bring her back on to the status.
Which is the best option? Apply for 539 or travel to India and get H4 stamped based on my H1?
If travel back is the easy option, do we expect any queries or questions from VO of her status during her H1 stay in US? Will they be able to track what is her last status in US?or we can just simply submit my H1 papers and apply for a H4 visa?
Please advise...
