View Full Version : Eager to get settled in USA

Hi everybody !! I have found this site really useful where everyone tends to share and advise each other whole-heartedly.

I have just got married recetly. Me and my husband wants to get settled in USA for good. We have planned that first I will be applying for a visitor visa and then subsequently apply for extension from there, and then call my husband. I am not sure how far we are correct in thinking this.

Would somebody please guide us.

I doubt if it would be so simple....
as you would have read on this forum, getting a visitor visa itself is a major task...and extension is something people very rarely get...
and then again, if you want to settle down here and do things legally, it is best to not go the "visitor visa" route, it would be better to either look for a job and a visa or a student visa etc...which again is not the easiest thing to do! :D

My parents just want to come here to visit me for a month and they are always accused of being potential immigrants.... at the age of 70...!!!!i guess thats the case with most people on this board.Now since you are a genuine potential immigrant...i wonder if it will be easier for you.As the previous poster said,it would be better to do it the legal way..get a job or become a student etc.

You seem as knowledgabel about immigration matters as my 4 year old son ! Sorry if I sound harsh, but what you are suggesting translates to 'I am thinking of commiting robbery, is that OK !'. Because what you are planning to do is illegal. Also, once you are here on a VISITOR visa, you cannot invite anyone.

The legal way has been suggested. Either as a student or employment based visa.

I too was very sceptical about this approach that is why I decided to share with VERY KNOWLEDGEABLE PEOPLE OF THIS SITE.

There is still one more doubt in my mind, after allowed entry as a visitor, can I then apply for a green card ???? I know you guys must be laughing on my questions, but i htink this forum is the best way where I can get my misconceptions clearerd ???

Can somebody please suggest me some good sites for getting a job in US ??/

Based on the info, this is the general opinion :
Assuming the sponsor is a US. citizen, that is possible. However, the process of obtaining the green card takes much longer in the U.S. than from most countries abroad. Also, the consulate believes that it is a violation for a person to enter as a tourist on a non-immigrant visa and then file for the AOS to immigrant. There are doctrines of fraud that come into play. So consider all the options and risks and make the best decision for your family.
Distant relatives cannot be sponsored in the above manner.

More distant relatives, such as aunts / uncles, cousins, and grandparents cannot be sponsored for a green card. Even U.S. citizens cannot petition for these relatives. It may be possible to invite them for a temporary visit on a visitor's visa, depending upon whether they have sufficient ties to their respective home countries to show that they have no immigrant intent. Of course, they may also be sponsored if they are qualified and the sponsoring relative owns a business or is able to find employment for the foreign national relative under the employment-based preference categories

In fact you even answered my next question which I had in my mind. My Masi (my mom's sister) stays in New York. What help can she provide me ? One, she can sponsor me as a visitor ... and ??

Are there some companies in US which sponsors work visas for Indians ?? Can somebody suggest me some sites for this ?

Or kindly suggest me some way to find a job in US....

Best option is

Ask your aunt to sponser a visitor visa for you and your spouse. Then you can go to US in B1/B2.
You can attend interviews over there and get the H1 Visa. It's intially valid for 3 years. To be honest, it's not advisable to look out for a job when you are in B1/B2.
You have to impress the employer who inturn applies for your Green card.

Guys correct me if i am wrong here.....

Actually i am a little confused here myself...most of the ppl i know either came here as students and got a job here or their company in india sent them here on a project and maybe they switched to a company here directly.i am aware that ppl come here as visitors and also search for jobs,but dont know wat the legal problems might be.
Maybe Murali might have some idea.But if you have relatives here that could be an entry point for you.

I have a friend who is on a visitor visa in the U.S. If he gets admission to a school here and gets an I-20, would he be able to change his status to student?

It is possible to apply to change status from tourist to student. Whether it is approved or not depends on several factors including how long your friend was here before applying for the change of status, what s/he told the consular officer when s/he applied for the visitor's visa in the first place, and whether s/he has adequate financial support to go to school. An additional factor that is sometimes raised by INS, but more often by consulates, is whether or s/he can show an intention to return to her/his home country.

I am in the U.S. on a B-2 visitor's visa. Can I apply for an H1B visa while I am here?

A person on a B-2 tourist visa is allowed to apply for an H1B status within the United States. Rather than filing to change the status within the U.S., it is better to file for the H-1 indicating that one will go back and pick up the visa. If instead, one changes status in the U.S., this could create problems later on when the person travels abroad and applies for an H1B visa in the home country.

As for the jobs in ur area - there shld be a few - please check h1bsponsors.com, h1base.com, monster.com and find out if any companies are willing to sponsor h1b
Alternatively, u can do some courses in advanced computer technologies - which would make it easier to find a job inthe IT field -

Since you are a mechanical Engineer and I am not sure what the job market is in US, I will suggest you to look at Canada, Australia, UK or New Zealand also as alternative place to immigrate. Immigtrating to US is very diffcult compared to the above countries. e.g. For Canada you can yourself apply for Permanent Residence, which we call Green Card in US terms. You do not need any spnsors, Also the whole process takes no more than year or so and the advantage is you can sponsor your relatives as soon as you become a PR Resident in Canada. Even if you finalyl want to settle in US, you can come via Canada as it may be easier for you.

But Siva, I wanna ask why is it that "it's not advisable to look out for a job when you are in B1/B2". Can you please advise on this.
