Hi,

I am in H1 now.. I am applying h4 for my wife who is pregnant and she is planning to come here in another 2 months..

I am kind of worried about my job ( I am a full time employee, not contractor) in this difficult economic times.. Say, if I get fired during her 8th month of pregnancy and If i dont get any other job with this bad economic times, I am not sure what will happen. After 8th month she basically can not fly and as I would go 'out of status' she would also be 'out of status'.. Does anybody know what happens in this situation?. should we go out of US no matter what stage of pregnancy she is in.. Or if we had to stay for health reasons will it become an issue later?

I know I am being paranoid but I can't get this question off my mind. It would be great if somebody who knows could answer

If you lose your job, you will be offered COBRA for you insurance. It will seem expensive but will be worth it with your wife's situation.

You can risk the out of status; as long as your I-94 is valid, you are not illegally present and accumulating time to a 3/10 year bar; you cannot be picked up and deported. This OOS becomes a problem for a GC and will keep you from transferring to another company without leaving and reentering the country. You can apply for a COS to B2 for a maximum of 6 months.

I suggest that you look to see how portable you will be so you know if you will be able to get a job after a layoff.If you have realistically assessed your future job potential, you can make an objective decision about whether to leave or stay.

will your company notify uscis or revoke H1 since they no longer needed ur services, if that's the case then i will suggest to find another company rightnow itself and xfr ur H1, if u get laid off, u can join new company since xfr is already done.

If you feel this way, it would be better to ask your wife stay back in India and deliver the baby. At that time, based your position, you can bring your wife and kid. This may disappoint you, but atleast it will be easy to switch jobs when you are single.
