Do I need to pay tax for below 6 months working in USA?????
If so how can I get the refund??????

If you were on a work visa, no.
If you were on student visa and had SS withheld, yes. Actually you would get this by filing income taxes.

Thanks for ur reply...Actually I came to USA with H1B visa on April 14th 2008 & for some personal reasons I am returning back to India on October 4th..... So here I am going to work nearly 5months 5days....Already my employer deducted some tax amount while he paid every month.... Can I get refund the amount while I filling my tax???????????

On H1B you are required to pay taxes. File income tax before April 15, 2009, and you will likely get a refund due to the short time you have worked. You must wait to get the W-2 which gives amounts earned and paid which is due to be sent before the end of Jan 2009.

Thanks for your reply & the way to get the refund.... Actually the total no of stay in US for me is that 174 days including POE date & Out Date and in that i worked nearly 173 days, means I got paid for 173days. Now can you clear me will I able to get the refund.

I know of no reason you should not get a part of your taxes back as a refund. The reason is that your taxes are calculated by your employer based on you earning that monthly amount for a full year. Taxes are progressive so that the more you earn the higher the tax rate; when you work only part of the year, the effective rate is lower than the rate at which the taxes were withheld.
You will need to get the W-2 form which is issued before Jan 31, 2009 and should file before April 2009; you will need to review carefully the requirements for the proper form that needs to be submitted. While I have done taxes for many years for my family, I have never used the NR forms and compared. The IRS website has many FAQs answered.
