L1 -- H1 Cos query

Hi all,

My friend is below situation.

One of the consultants has applied for L1->H1 COS this is for him and the application is selected and in approved state.

However my friend wants to continue on his L1 for some more time. ( say 6-8 months from now ) and later he wants to work on H1

But looks like , He would be out of status on L1 after 180 days from the H1 application submission date. ( from Oct 1st)

What can be done to continue on his L1 ? Does he has go out from USA and come back ?

As per the information available, this is a change of status from L-1 to H-1B therefore your friend's status will automatically become H-1B from Ocotber 1, 2008 onwards. Now we are in end of August month, therefore If he goes out and comes back in september, then definitely port officer will see all information about your friend in their database. If he is stamped with L-1 visa then his H-1B will become void.

Hi, Thanks a lot for your reply. He actually applied for H1 ( Conversion from L1).

So the actual H1 would get void if goes out from USA and reenters or only the COS will become void ?

Can you use his H1 later ?

COS will become void and later he can use H1. H1 will remain valid.

Would this L1--> H1 COS can create a problem there ? What are the chances of getting this L1 VISA extended

Does the Visa officers have this information(L1-->H1 Cos ) updated in their Data Base ?

doesn't matter, anyone can have both visa's but at a time can have only 1 stamp.
