Hi Murali,
My parents (who have 10 years multiple visas) came to USA last week and we planned them to stay here for 5 months and had return ticket after 5 months. But somehow the immigration officer at port of entry gave I-94 for only 2 months. Can we go for their extension? If I apply for extension and I won’t get reply before 2 months can they
Stay here for 5 months till we get the answer.
1) If I receive the negative answer after 5months after they left the country will that affect their next visit?
2) As they came here last week, what is right time to apply for their extension?
3) What would be the better reason for extension?
Please advice.

They were given a limited stay for a reason. When were they here last and how long did they stay?

If you search the forums you will find that everyone will advise against applying for an extension especially if they have been given a stay of less than 6 months. They risk having their visa revoked or not renewed if they have a pattern of abusing the privilege of a visitors visa.

The correct reason for asking for an extension is the TRUTH. If you apply for an extension, it will most likely be denied unless you have a very good reason for the asking; having tickets scheduled for later than the I-94 date is not a good reason.

IMO, it would be in their best interest if they returned home before the date stamped on their I-94 and did not ask for an extension.

Hi,
This is the first time they came hear after their 10 years multiple visa stamping.Reason we are planning to ask for an extension becuase 2 months are not enough to visit all the places and not as they are having thier return ticket after 5 months.

You can certainly try. Since they have never visited before, I feel there is less of a problem than if they are returning after a recent visit.

I would be sure to be specific as to their plans and include any special date specific events - such as a birthday, wedding, holiday - that is in that time frame.

The processing time is such that they will likely have left before receiving their notification. Be sure to have them save their return boarding passes and carry a copy of their extension request so that they can present it when they return in the future. Remember if the extension is denied, they must make plans to leave promptly.

By the way, what part of the world are they from? I found that family visiting from South America received a short date as well. They had planned to stay just a couple of weeks so it was not an issue at the time.

There is no correlation due to their home countries.

I'm not sure what I would do in your situation. Remember they can always return in a year or two during a different time of year. You don't have to sightsee the entire country in one visit. I would find it very hard to be away from home for such a long time; I worry about my house being done for a week!

I hope they are having a nice visit!

Hi Murali or any Sr.Memeber:

My Aunty received 6 months I-94.
If I use attorney to extend I-94 for vister visa (B2) extension (i.e To my Aunty, she needs to extend I-94 who came first time to USA and having 10 years miltiple entry).
Because using attorney is there any more chances for rejection by considering potential Immigrant chances etc...)

Using attorney should not affect the decision either way over an individual applicant as long as the individual was able to properly prepare the documents.

Murali or Sr. members:

when we apply Visiter visa last year(2007) for my In-laws I sponsored my self (i.e I send only my documents to get visa) though me and my wife was working on h1b.
where as Last year November only my Mother in-law came to US (on b2), now we are planning to apply for extension(I-94), as we are applying for extension is it mandetory to apply my self on behalf of my mother in-law or my wife(as she is also working on h1b) can also file for her mom I-94 extension, Since my curent h1b valid only few months (and I need to apply for h1b extension my self too).

A)As I sponsored, only I need to apply for for extension(I-94)
on behalf of my Mother in-law ?
B) whether My wife (for her mom) can file for extension ?
C) If my wife applying for extension, on I-134 affidevit do we need to put total family Income ? If so both should sign or Just my wife can sign ?

please clarify A, B, C.
