We just got the vistior visa extension approved. Here are some facts & details.
Schedule :
-----------
orig i-94 expiration : End March 2004
Extension applied : Mid Feb 2004
Extension requested : from March thru Aug 2004 (for 5 months)
Recd extension Receipt: early March 2004
Left USA : early May 2004 (stayed a little over 2 months)
Extension approved : early Sep 2004
Recd letter : end Sep 2004
stay approved: from March 2004 to May 2004.
new i-94 :sent along with the approval letter.
Facts:
- didn't send original i-94 along with visa extension application
- moved to new address after sending the paper work to USCIS
- USCIS will send all communication to address-on-file only.
- if the USCIS letter is marked "do not forward" , then it will not be forward but will be returned to SENDER as un-delivered mail.
- went to old-post office to get the letter before they tried to deliver.
- Left USA around May 15th 2004
- stay approved from March thru May 14th 2004 , seems like there is a co-relation when we exit usa with pending extension-approval

Thanks for posting this information about visa extension.
What is the difference between Extension approved and Stay approved?
I see from your note that the first one is till Sep 2004 and the second one till May 2004.
Also what kind of a letter did you write, I mean what are possible valid and non controversial reasons for extension?

My parents came here in jan 2004 and we applied for extension for both of them,we were under the impression when applied we can stay until a decicion is made ,but in august we got a denial, then within 7 days they left.
Now they are planning to come in Jan 2006 ,what will be the hurdles for them.

Hi,
I have been reading all posts and get an impression that the approval/denial is taking a good 3-4 months to come through. My parents are here on a 10 year multiple entry visa and I need an extension for them. The questions I have been having are:
1. Does it make more sense to apply close to I-94 expiration date if they wish to extend only for 2.5 months so that even if they get a rejection it would come after they have already left or does any one have know of any reason wh this late filing staretegy is not a good idea ?
2. They have been here before ( 5 years back) and had for an appoved extension done that time too, does that play negatively on their case this time ?
3. What should be the supporting docs ? I read the website and it says proof of financial support what is that supposed to be ? Also anyone has a sample letter with good reasons for this extension to share ?

1. it is recommnded to apply after a little while , If you apply immidiately compratively soon after entering to USA, INS may get the impression that it was pre decided and planned to extend and may have a negetive effect.
2. I dont think so , as long as they have a clean history of not over stay in any of their previous visit.
3. Bank statement of sponsor generally work.

Have you heard any help reply? I have similar question. My parents came here in Feb.2002, I submitted their first extension and got approved in less than 1 month. Then their visa was extended to Feb 2003. Serveral friends around me got their parents 2nd visa extension approved. Therefore I applied for my parents' 2nd visa extension in early Nov.2002, the receipt said this kind of case will take about 45-60 days to process. Our plan was even their case was denied, we still have enough time to schedule to go back to China, because their visa was vaild till Feb.2003. Unfortunately we didn't hear anything from INS, until 3/17/2003 we got denial letter. It has past about 50 days of their valid status. The letter said starting from today, you are at invalid immigration status. If you leave US in less than 180 days, you will not be banned for 3 year not be able to entry US. The worst case was at that time China had very serious SARS. My parents stayed till early Sept. 2003 to go back China.
Now I want them to apply for vistor visa in the coming Oct. I'm afraid if I check YES for form DS-156 item 38 (have you ever violated the terms of a U.S. via, or been unlawfully present in, or deported from, the United States? Their application will be denied. If I don't check YES, then Embassy will find out the truth, they will be in big trouble.
Please help, What should I do.

Hi,
My parents who have a 10 year multiple entry visitor visa are currently in US and there I-94 is going to expire shortly. We applied for six month visa extension and received a case number from USCIS few days later.
Haven't received a decision on the case yet. Status check on the case tells that it may take a while(can go up to 120 days) for processing the case.
My question is can they stay in US until we hear USCIS decision on the case or should they leave the country before the current I-94 expires.
Please advice. Thank you in advance.

I too have similar situation. My parents visa extension got rejected & we received the denial letter ~2 months after original I94 extension date.
Now parents are coming back next month. would there be any problem at port of entry? what papers should they carry? How should they convince port of entry officer about the overstay?

I have 10 Years Multiple Entry visa. I got my I-94 date as Sept 27th, but for some unforeseen reasons I could not complete the task which has been assigned to me. I need to stay here till Oct end to complete the formalities.
I need to following information :
1. My company is finding out the formalities to extend my I94. Is it ok to apply now. Today is Sept 4th already.
2. Will this be seen as a black mark by US customs during my future visits?

My parents have 10-yr multiple entry visa and they are visiting US.They are likely to stay for 8 months. Usually I-94 will be given for 6 -months. I heard that if they buy a roundtrip open ticket for one year then at the port of entry they wil get a I-94 valid for one year or so? Is this true? Has anybody done this earlier.Please help.

No, by rule for B1/B2 visa the max I94 can be given is 6 months.
You can apply for extension later by filing extension for another 6 months.

I am applying for an extension of visa for mother. I understand that one needs to write an application giving the reason for extension. My question is , who needs to write this letter ? My mom has just arrived in the US a few weeks back.She has travelled to England and Australia before and this was her first visit to the United States.
She has a 10 year multiple entry visa to the US.On her arrival at NY the imigration officer interviewed her for good one hour asking all sorts of questions about her previous visits to Australia and London, her purspose of travel to all these countries and her education and profession.It was only after she said that shes a retired professor from Delhi University and her purpose of visit to US and all the other countries is purely tourism they granted her 6 months stay but even then the officer closed the conversation by saying " We recommend that you leave US before or on 15th April and then you may come back again"
At this point I am still confused whether its a good idea applying for her extension or not?
Do they keep a record of the entire conversation? or do they flag people who were questioned more than the others.The interveiw was that long that she even missed ger connecting flight to Dallas.
Your adivce and opinions are higly appreciated and will help me make a decision.

Unfortunately I got denial for my mom's extension last time and now she has to reapply for visa even she had 10 years multiple entry visa... too bad.

That is not correct, Getting the denial doesn't mean to re-apply again if she already has the visa.
Her 10yrs visa is still valid, if she overstayed during her last trip she may be aksed questions etc at the POE but her visa is still good.
Make sure she carries all documents related to her last visit :

- I94, Extension applicayion receipt fron USCIS, Letter denial, Last visit's boarding passes, etc

If that's true then nothing like it. I was really upset to know when I am expecting my mom to come in US next week. But now I feel better after your reply. Do you remember seeing any post where people mentioned that parents could come in even after overstayed.
That will really clear lots of doubts.

My parents recently came to USA but at the port of entry in LA they were stamped B1 visa for 3months.
Now I want their visa to be extended for 3 more months.
But I have some questions:
1. I am not sure why they stamped B1 visa.
2. Can I extend this visa like regular visitor B2 visa .
Please let me know if anyone else had the same experiences.

Hi,
I have a 10 year validity on my B1/B2 visa and i was given my i-94 until the 17th of April 2006. My company decided that i needed to stay longer and have mailed the I-539 form along with my original I-94 to the service center in Nebraska asking for an extension.
My question:Incase i dont recieve a response from them by the date my legal stay expires, can i leave the US without any issues?
Can i leave the US and go to another country, lets say Jamaica and return to the US on a B1? requesting for a couple of months stay? or do i have to return to my home country which is India?
I was hoping that you could point me in the right direction.

Once Original I-94 has been sent with your I-539 application, you cannot leave the US since I-94 is considered an Arrival/Departure record. You can enter Jamaica without any visa if you are a citizen of India. ( any British commonwealth country passport holders are exempt from visa's). However, the KEY is that you CANNOT leave the US until to hear from the USCIS as to the status of your case. You may stay in the US past the original date of your I-94 (17th april 2006) as long as you have the original receipt notice mailed by USCIS regarding your application. ( I-539). you may want to staple into your passport until you receive approval on your extension application. thanks.

Hi,
My in-laws are here on visitor visa. They have a 10 yr multiple entry visa and the I-94 is going to expire on 23rd June. I am planning to apply for an extension in next couple of days. Please let me know if this is too late to apply and if this (the delay) will have any bearing on the outcome.
I also have a few questions on the documents that I need to submit. What kind of proof of financial support do I need to sumit. Is the regular monthly bank statement sufficient or I need to get a special letter from the bank which will say that I have enough fund to support their extended stay.
Also, what should I say as reason for extension. Is there a sample letter that someone can share with me.
Please advise. Appreciate a quick response.

Applcation for extension(postal) sent on: May-12-06
Application reached VSC : May-17th
VSC took the application in on May-30th and generated the Receipt : May-30-06
Saw the $200 fee taken away from back on Jun-01-06
Received Receipt Notice at home by post on: Jun-05-07.
Requested stay date till Nov-end-06
Waiting for the verdit - Current processing time is around 90 days..

Just received the visitors visa extension approval notification for a relative.
Here's some background / additional info:
I94 expiry - Jul 30
Mailed i539 along with supporting docs to uscis on - Apr 28
Receipt date - May 5
Requested duration for extension - 1.5 months.
Notification of approval received on - Jun 30
Documents sent along with the petition:
1) Copy of i94 and passport pages
2) Detailed letter with reasons for requesting extension
(Tourism, visit east coast etc)
3) Copy of existing travel itinerary (showing departure date before Jul 30)
I did not send any proofs of return travel - Noted in the letter that I will book the tickets after getting the decision from uscis. According to the rules, u may be able to stay till u get the decision on ur case. However will have to depart as soon as possible if u get the decision that the request has been denied

Hi, I am now also applying for the extension for my in-law. She can stay until midmid Aug too. Here is what I put in the cover letter. You should change it to reflect the facts as much as you could.
Here it is.......
I am filing the form I-539 to request for a permission to extend my stay in the U.S. until February 14, 2007.
My main purpose to come here is to visit several U.S. most visited tourist areas, i.e. San Francisco, Los Angeles, San Diego, Las Vegas, Grand Canyon, New York and Washington D.C. So far, I have visited places only in California. My daughter-in-law can show me around only when her school is not in sessions. Now, she is working as a teaching assistant for the whole summer and need to finish part of her research by the end of fall quarter. As a result, we have to postpone our trip to Las Vegas and Grand Canyon to be during her winter break in December and then I plan to go to the east coast at the end of January 2007.
Since I am retired and both of my sons are paying for my stay in the U.S., I can stay a little bit longer than I first planned. Moreover, it would be really nice if I could be here to see my grand-daughter starts her first day of kindergarten school in September. (My son and my daughter-in-law finally decided that my grand-daughter should start school this year even though she is not 5 years old yet.)
I have an airline ticket open until February 15, 2007. I am requesting to extend my stay until February 14, 2007 if possible. However, I can make a reservation for the return flight according to the USCIS decision upon my extension request.

We are not sure if INS will send the extension decession before the I-94 expiry date. Can my parents wait for the INS decession even after the I-94 expiry date? Hi,
I am here in the US on a visitor visa (10 yr multiple entry). My 6 month period gets over on Aug 27. My original I94 stamping was also stamped for the same date. I had been to Canada on a tourist visit for 1 week. I was issued a new I94 with a new stamping date of Sep14 (15 days extra).
I did not have any intension of extending my stay for more than the 6 months but now that the new date has been stamped for Sep15, I am wondering if I can extend my stay for another 15 days. Is this legal? Should I stick to the 180 days timeframe strictly to avoid problems in future visits to US.
If anyone has any suggestions, please let me know.

is available on the site.You can wait for the out come but leave IMMEDIATELY, if rejected.Instead of that tension enjoy for some time and send her before negative orders are received to be on safe side.

My advice is to apply for extension 3 months before I-94 expiry if you dont get a reply within 2 weeks of the I-94 expiry , please send them back.
Its not worth the tension and wait, see this whole thing of rentry after overstaying for an extension is a very grey area, no one knows how it will play out , i have read quite a bit about this and got advice from many attorneys, but i acted against all of the advice and all of what i read and I brought them here and they came in without any problem , maybe thats the case for everybody or maybe with Gods Grace i was just lucky, we might never know this.
so my advice is pls dont overstay waiting for a reply its not worth the risk of losing a 10 yr visa.

We applied for my mom's extension on 7th august(reciept date)-- just 3 days ahead of her i-94 expiration date.
and received approval for extension with approval date of 8th september --- she got approval for 5 1/2 months.:)
the reason we gave was -- she wants to spend more time with her grand kids ... which is a true reason!

I am happy to see this forum where everybody share their experiences. I was in dielemma whether to apply for extension of my mom's visa by another 3 months. After seeing positive response here I decided to apply.
Her I-94 is valid until Nov 6th. How early should I apply for her extension? One way I feel if I apply right now I would come to know the decision early and that way she doesn't have to overstay.
But I have also heard of cases where someon'e 10 -year visa was cancelled when extension was denied.. Is there such a possibility?

we applied in california service center --- and we really took a gamble by applying just 2 days before i-94 was expiring -- but i would advice you, apply atleast 45 days before -- just to be on the safer side.
and about cancellation -- i donot think it is true ,, because i heard of some cases where parents went back immidiately after denial, and came back after a year or so on same 10 yr multiple visa.

It is confusing any how.Appln of 31st July.Refusal received on 12th Oct. with date 22nd Sept.whereas the processing timings shown with 19th Sept.06 still continue with back log of June applns.Anticipated notice in first week of Nov. and fixed tentative date.Every visitor is bound by decision of USCIS.If knows in advance people may have mental satisfaction of leaving after pleasure instead of feeling that they were shunted out.

I have a 10 year multiple visa for usa . due to some medical grounds i overstayed in USA for more than 1 year. I dint apply for extension as I got the entry only for a month . I am back in India of my own and gave my I94 to the Airlines staff . I am sure now I must be barred to visit USA as I overstayed . Can I apply for a waiver on barred to visat usa ? Is there is any way i can confirm that bar ? what is the best option if I want to go back to USA

Do we need to send original I-94 along with 539 for extension? Bcos we didn't not send it and I am really worried now that it may get rejected.
In extension tracker someone mentioned the reason for refusal was not sending original I-94.
Now that we already sent our application and got receipt also, what are the choices that we have? Could someone please throw some information.

I am new to this forum. In order to apply for the extension, do the supporting documents have to be notarized. Example is it sufficient to send copies of bank statements and original bank statements. Are copies valid?
If I write a letter of support for my parents does it have to be notarized?

Hi,
I need to apply for Extension for my in-laws stay. They are here on B2 visa.
Their I-94 is valid till end of Jan-07.
Is it possible to apply with one I-539 form with Mother-in-law as main applicant and Father-in-law as the spouse at the end of the form.
OR
should it be 2 separate I-539 Forms - one for Father-in-law and one for Mother-in-law?

Hi, can some one pls pls pls send me a sample letter that lists the reason of the requested extension? I'm planning to file extension for my in-laws whose I94 expires Mar27 and their return tickets are marked Mar20. do I have to change their return ticket (to a later date corresponding to the extension, like May 30, etc) and send that to the service center along with other documents? or do I keep it the way it is , just in case of denial they can leave the country on the previosly planned date?
any input on this would be greatly appreciated.

Hi everybody,
currently I am on a tourist visa until the 20. of february.
I have allready applied for an extention on the 23th of january.
I have heared that the answer will come after 2-3 month.
1.So if I leave the country before I have got the answer do I have to bring all the papers with me to leave? correct ?
2. If the extention is denied I have to leave immediatelly what does that mean? 2 hours or two days or two weeks?

My mom came to US this week but they made her wait on the airport and approved stay for only 3 months
they also said they will cancel her visa if she tries to come back within couple of months.
Past History
got visa in first shot in 2005
stayed from july 2005 to jan 2006
came back in june 2006 stayed until jan 2007
came back again in april end 2007- DENIED STAY FOR SIX MONTHS
should i apply for extension
please tell me what r my chances

Visitor Visa B2 is for a short term torist purpose only.
Any frequent visit ( more then 2 visit) in a year is considered to be a dependent and potential immigrant, and they may cancel the visa even can deny entry to USA.
I wont recommned for extension unless it due to any medical /genuine reason.

Hi,
My husband is actually recovering from Cancer and my parents came from India to help us out. They came originally in September 06.
My husband underwent Stem Cell transplant around 2 months back and realizing that we would need help, we applied for a 3 months extension, that, if approved would have permitted them to stay till June (We have not gotten a reply yet). But he is now having some complications and we really need them to stay for an extra couple of months (At least till August).
Can I submit another extension request for 6 months now? or do I wait for the 3 months extension to be approved/ rejected before trying again? Or can the VISA be extended multiple times?

My parents and niece came before two weeks and they are issued only 2 months I94. I thought that I will send my niece before two months but I am not able to find comanion for her and also no return dates available in June so planning to file extension for another 4 months for all.
Do I need to file different applications for all?
Is there any risk for filing for niece, she is 9 Yrs. old?

My mom was here last year, she left after 8 months with approved extension of stay. My question is do they keep the approval on departure and do they leave I-94 on passport. I think they did not take extended I-94 by mistake and took previous I-94, is that going to be a problem when she comes back. Any info. Murali?

I am planning to apply for visitor visa extension for my parents. If we do not hear back from USCIS about their decision before the current I-94 expires, is it legal for them to stay past this date? I have read contradicting things about this in other websites. Someone please clarify. I have read that, as long as extension is applied before I-94 expiration date, it is legal to stay in the US upto 120 days. Is this true? Also, 120 days from the date of application for extension or the expiration date on I-94?

Hello I wanted to apply for extension of my parents stay . I need some information.
The affidavit of support should be signed by ME or by my husband ... boh of us are working full time ... but my concern is if I show that I am working USCIS may think I am keeping my parents here to babysit ... which frankly is not thecase since both my kids got to DAY CARE....

My parents came last week. In immigration the officer told that he has approved their stay only for 3 months. But in I-94 they have 6 months validity.
My confusion is that in their system they might have only 3 months.
1. Can we just ignore what he said and stay for 6 months as I-94 says so. Will it be a problem when they come back later.
2. Should I contact them and confirm what is the validity

When my mohter-in-law came here in February, she filled the I-94 with wrong info. She put my name on I-94 instead of her, even Immigration Officer didnt look at it in detail and stamped the I-94 for 6 months.
We want to apply for her extension now, of course it's going to be a problem since her name on passport and I94 doesnt match.
Any similar expereinces?

My MIL visited US in Jan07 left in July07
She came again in June 08--Present(I94 expires on Dec23rd 08)
Now we like to apply for a stay extension beyond Dec23rd as we need her to take care of our new born.
when I apply for extension, can I specify how much more time I need extension for after Dec08? can I apply for another 6 more months stay? (Dec08-May09)?
Which is the most appropriate time I should apply and for how many months more can we request the extension for, to make sure that we will have maximum chances of approval of the extension?

Many of the embassy websites explicitly state that childcare is not an appropriate use of a visitor visa. The mother of the child is perfectly able to do so with the help of the child's father. If the mother needs to return to work, she needs to find child care; if the parents choose not to place the child in the care of professionals, one of them needs to remain at home.
Please don't abuse the priviledge of visiting the US. It is behavior like this that makes it difficult for others to obtain visas.

My mother was here On Visiting visa 9 months[/B](< 9 months) for the first time (Initially she got 6 months I-94 and we applied for extension before I-94 expired and later we received denial letter and then she left India ).
I hope her 10 years multple entry Visiting Visa will not cancel ?
Now my question In order come back i.e Visit US again how long she need stay/wait in India. I know some people who got extension approval they left US after staying here 10 months, and stayed in India 6 motnhs and came to US again,
Since one time extension-denied, do we need to fallow something diffatent way.
Note: All together my monther came to US only one time and if she wants to come back 2nd time how long she nees stay in India.
