Can I apply L1 if i am having H1B under query

Hi ,

Could you please anyone tell me whether i can apply from my present employer L1 if i have my H1B is under query i.e., 221G.

My US Employer is not giving me docs required for H1B after i got query.
so iam planning to apply L1 from my employer in india .
I need to i there is any legal or any constarints.

Please answer my query and i am very very much thankful to you all.

yes u can apply for L1, but b4 that u need to withdraw ur H1 app. call the consulate to findout how to do it.
