View Full Version : H1-B Visa 221 (g) in Seoul, South Korea

Hello experts,

I need some advise and moral support from you folks.

I work in Santa Clara and came to Seoul on a business trip. So, I applied for my H1 stamping on the Dec3rd, 2007. I was asked some normal questions about my work, my degree in Materials Science (PhD, MS) and the current work I am doing in the US. I answered them but looks like I was a bit technical and specific in telling him. The consular officer nodded with enthusiasm and did not ask me further questions about my work. He asked when I got the job (straight out of school after graduation I told). So, I figured everything was ok. He also asked me why I was seeking this in Korea. I explained that this is the first time I traveled after being in H1 status outside of the US, that too because of the business trip and never had a chance to go out before this. He seemed ok with everything and called me later showing a 221 (g) form colored dark grey, unlike any other colored 221 (g) s in this forum! He asked me for an updated resume and complete list of publications and a letter describing details of my work. I gave him my resume immediately which included some selected publications of mine and emailed a letter describing some details of my work. Apparently, he felt that the letter given by our immigration dept in our office was too general. It was at this point that I felt perhaps the consular officer felt my work was probably classified or something based on my answers. I did not hear from them again until a week when I contacted them again requesting earnestly for the status. They answered me that my documents have been sent for "adjudication" and the USCIS has started processing and it may take 2-3 weeks or more...

Meanwhile I found out the USCIS contact number in DC and checked with them. They said my application has been put in a security check and normally the fast track (which I am in) takes 4-6 weeks..or more.

I am wondering if anyone else has been through similar situation or if you have an idea about this, could you please give me some details about what this "security check" means.

My company applied for my green card and I got my EAD. My AP (advanced Parole) is still in process. Not sure if this was affecting it. My attorney confirmed I could travel. So, this probably is not an issue.

Seeing the times being taken for processing in the message board here is making me a bit nervous.

I am not sure how long I may be stuck in Korea! Fortunately, my company is still covering me for accomodation and all costs as I am working on our customer site and probably they will for some more time. I am not sure however, this visa is going to take? My wife is in the US on dependent visa and I am praying this will be done ASAP in like 4 weeks at the most.

Any advise will be appreciated!
