Hi

My H1B visa expired on 16th Feb 2004 and this visa was valid only for two years. I had my I 94 also valid till 16th Feb 2004. I got a I94 extension till 8th October 2006. I want to go back to India for vacation. Obviously, I will have to get a visa stamping done since the visa expired in feb,2004. My question is that what are the chances of stamping being done if i have a valid I94? Is the visa rejected in H1B category if the person has a valid I94.??

so your questions seems to be little confusing.

OK if you a valid h1 extesion you can get the ne stamping in your country's US consulate.
I 94 should not be any concern in such case.

Since now revalidation is not possible in US, i certainly have to get the stamping of visa done in India. I just want to know if the stamping will be done easily on the grounds of a valid I 94 or it can be rejected too?? I am a little worried abt the visa not getting stamped in India. Have u come across any case of rejection in H1B category when a person was provided a valid I94. Is there any work around of getting the visa stamped/ visa revalidation in US itself.
