View Full Version : I-94 expired, extension applied - what documents to carry while flying back to India?

Hello,

My wife is on a L1-B visa. Her I-94 expired Oct 24 2007. Needless to say that we have already applied for an extension and it is still under consideration.

Due to personal reasons we have to fly back to India in December 1st week. We might or might now have a decision from the USCIS yet.

**We know that it is legal to stay in the country after the I-94 is expired if an extension is filed till a decision is made.**

Questions:
1. Can there be any issues with the airline or at the airport while we are flying out since the I-94 we will return would have any expiry date of 10/24/07

2. Would carrying the application receipt help?

Why dont you upgrade the extension application to Premium Process so that you can get the the approval before December 1st week

no visa on passport no entry into usa,bottom line.
to get visa you need approval.
bottomline no use in coming back without visa.
