View Full Version : Can I have L2 and H1 both?

Hi Murli and others

I am try to process my H1 this year. I have another option of filing an L2 since my wife might be going on L1.
My query is can I have both H1 and L2?

If not, I am planning to give preference to H1. Now, in case I want to change my visa to H2 later, do I have to come back to India and file a L2 or I can get it xfer from H1 to L2 in US itself?

Please suggest!!

You can have either of one status L2 or H1.
which ever you get later will be the one...

Thanks for the quick response.
Now, If I am in US on H1 and want to get an L2, do I have to come back to India and get a stamping or I can get the L2 stamping done from US itself?

You have to go out of USA, get the L2 stamped and enter back into USA on L2 visa.
Stamping can not be done in USA.

Thanks again for the prompt reply. You are doing a great help to all of us.

I have another query..request your reply..
If I go on H1 and due to some reason or the other I dont want to continue with the company and they dont allow me to transfer my H1 either. May be I might want to fly back to India and file a fresh L2 if things are unbearable.

In such as senario, what are the most important document that I need to keep along with me to:

a) Fly back to India - I am not sure if there are any particular document that we need to show if we want to go out of US.
b) File a fresh L2
