I went for stamping in feb. for year 2007. That time VO issued me 221(g) asking me to submit some papers from my employer. She also kept all my original degree documents for verification. My employer refused me to give papers specially client letter.
So, I searched for another employer for H1B filing for year 2008. They filed H1B fo me & I got the approval also.
I never checked status of my previuos H1B as I thought if I will not be selected through lottery, previous case can be processed further.
After receiving H1B documents from new employer, when I contacted USCIS to return my original degree documents. I got a mail stating that I need to submit my & my dependent's passport. Also, I will get my degree docs back at the same time.
As per mail, I submitted my & my daughter's passport. I got it stamped 2 days back.
My problem is - I want to go for my new employer. I can never prfer my previous employer.
What will be the better option.
1. Should I go for new H1B stamping. OR
2. H1b Transfer
I don't know much about H1B transfer. Is it feasible in my case as I never went to USA & work over there.
In any case, I want to have atleast 1 valid H1B. My worry is if I go for stamping on new H1B or even I will have to meet VO in case of H1B transfer.
What if Consulate cancel my current H1B in order to process new one & issue me 221(g) again. In that case, I will again got stuck & not be allowed to work in USA.
Please help me how can I be ensured that my current H1B should not be cancelled till I get the new one.
Senior members, your reponse will highly be appreciated & will help me to come out of this situation.
