I received a ref that my Job did not fall in H1B catagory, additional evidence requested.Is there anyone who got this type of ref,and what's up after response.

Hi dude,
Cud u plz let all of us know what is ur background, as there exists one list might be on USCIS' website though not sure , which will throw some light on ur question regarding specialty occupation.
But I'm damn sure that there does exist a formal list mentioning all those occupations that fall in specialized category.
Hope, u might find something on the net (about this much needed list).

Thaks for ur response, Actually my attorney applied for marketing in a desi company.My qualifications are Masters in computer, Masters in Education, work experience in health services ,and applied for marketing in a health organization.now i dont know y they demand any evidence,they said that this type of job can do anybody so there is no need for H1B.Actually they need any evidence that my company requires this type of person, and they also need any axample of some other company.

Well it's a bit tricky situation for u, yr case can go either way .i.e chances of getting an approval are 50-50. Coz as far as my knowledge of H1 goes marketing in general is not considered a specialized field. But u never know if luck is poised in ur favor u might end up getting much awaited approval. Still i maintain chances r bleak. Lastly don't take my statement as silver lining.

To be really honest dude i don't know exactly what kind of papers has USCIS sought from ur employer, still taking into consideration what u wrote as USCIS asked ur employer to produce for the further assessment of ur case, clearly indicates that the USCIS guys need an example whereby ur employer can cite an instance in which some one was given H1 visa for marketing stuff. Moreover ur employer gotta show detailed roles and responsibilities in a such a manner that automatically conveys a message to the USCIS persuading them that ur future job really requires only the kind of background and experience u possess. Anyways best of luck man.
