Hi,
Let me present a background first. I have a long term B-1 Visa on my passport. Last year, my company sent me to US for a period of 12 weeks. Since my wife's appointment could be taken only for June, and I was leaving in may, we decided that I will leave first, she will appear for her interview in June and then join me. Company was paying all expenses of travel and stay.
Upon reaching US, the immigrations officials stamped my I-94 for 22 weeks instead of 12, though the return ticket I showed was for 3 months.
When my wife appeared for interview, the company admin people just saw I-94 days and put in the letter that I have gone for 22 weeks.
The consular person read the first line which said "22 weeks" and smirked "Business Visa for 22 weeks!!" She then said that I am sure your husband is gone for working there and you will also go and work and have children there and never come back, and then stamped "application received" on the passport.
No letter or form etc.,was given, just the passport was given back. There is only one stamp there which says "Application received".
I came back from US after my 3 months were over.
Its been more than a year now since that incident, and I may travel on a business visit for about 6 weeks. So I am planning to take my wife again.
Company will again provide support letters etc.,
I wanted some advice on what she should say when asked why was the VISA rejected last time.
She can always show the 22 weeks letter and my I-94 with 3 months stay in US. But over there hardly any time for explanations is there.
Also there is no letter given to us giving rejection reasons.
So whats the best approach.
One could be a clarifying letter from company which shows my I-94 entry and exit stamp on my passport along with their old letter which led to rejection.
Also many of you must have travelled on B-1 and taken your spouses on B-2. Is rejection common.
How much bearing does a year old rejection have on current status.
Last question, when somebody goes to reapply after a year, do they ask why was your VISA rejected over a year ago. Do they hear you out or if you have had a rejection your chance of rejection increases?
