I am in odd situation.
I am planning to invite my parents to USA. My H1B expires before they will appear for interview. I am on EAD and AP and I485 filed and since dates are current I am not applying for H1B extension.
And technically while filing the forms 156 and 157 I was on H1b but while appearing for interview I will be wothout H1B but still in status as AOS pending.
My questions;
1) will my parents get visa (I am sponser)?
2) Can IO see this situation and deny based on the I485 pending..?
3) Has anybody sponsered parents in this situation?
