Hi
I am in trouble. I have joined another consultant in US and he has not yet applied for my H1B transfer but the previous employer is saying that he is going to cancel my VISA. Someone please help me how to handle this situation.

on what basis did u join the new company if trx itself is not applied yet. only soln is to file for Xfr asap specially prior to cancellation petition.

I have just reached here in US last week and my new employer was about to file for it. So suppose the old employer has filed fo cancellation today how much time do i have to do it transferred? I am talking to my employer to file it asap.

Take it easy boss...from what I hear you have one month after your visa is cancelled that you can stay in the US...so that gives you effectively time it takes to get cancellation processed=30 days+1 month ...tht is almost 2 months to get your H1b transferred.
Another thing is that most employers do not file for cancellation of h1 as it costs them the same amount as required to file for H1b in first place. SO i doubt if he is kanjoos makhichoos consultant tht he will do tht (but chekc tht out yourself)

Thanks alfredo, is this the time after your VISA gets into invalid state(i.e) get cancelled or from the date consultant has filed for the cancellation of VISA. As my consultant has send me mail yesterday that they are going ahead and cancelling my VISA.

Girish,
Once your new consultant has filed for H1b transfer...it takes about a week for you to get a receipt number and when you have it you can legally work for your new consultant.
With regard to your previous guy...you have 1 month after processing of cancellation--which is after the cancellation gets processed not immediately when your ex-consultant applies for it.
What you need to do now is have your new guy process it as soon as possible.

best is to file the xfr using premium processing.
