View Full Version : Anybody got response from USCIS after review

Hi All,

I attended visa interview at Chennai Consulate during the first week of Feb-2007. After the review, i was issued 221(g), With the following message.


The petition being returned to USCIS for further review.Upon completion of this review USCIS will contact your petitioner. Please wait for a notification from the consulate before returning.

From the first week of May-2007, i started seeing the following message at USCIS site.

Application Type: I129, PETITION FOR A NONIMMIGRANT WORKER
Current Status: This case has been received from the State Department with a request we review it.
On May 5, 2007, our VERMONT SERVICE CENTER location received this case from the State Department with a request that we review it. We will notify you when we complete our review, or if we need something from you.


There were lot of cases returned to USCIS for review from Chennai consulate.
Did any of you have to go through anything simillar?. If so, please post your experiences.

HI,

My case has also been refered to USCIS and been sent to Vermont Service Center.

I have sent all my documents to Chennai consulate on 31 Jan 2007
but my case has been sent to USCIS, any any one experienced the same thing.

Are there any chances.......

Hi,

I have been seeing the similar message when i checked my application status in USCIS, but the date when USCIS recieved the application to review from the state department was April 9th. Till now no news from them. So just waiting for an update and i dont know how long its gonna take.

If anybody knows or prior experience please post the same..

Thanks for posting.

USCIS supposed to respond to RFE's in 90 days. I am not sure whether this is considered that kind of request. Some say, it might take up to a year.

In my case, it was employer documents that triggered it. According to employer and their attorneys, they documents are valid. Attorney requested to wait until the review is over. Let us hope for the best.

My wife's case was sent for review on Feb 15, 2007. No status change till now.

These days it takes four months for the USCIS to receive your case. Let me know whether any of your status changed. My rejection was on Feb 20. So I'm hoping that by June 20 the status would change.

HI! how r u doing?

I attended my visa interview on 1st dec,2006.They issued me 221g - Blue Form - The petition is being return to USCIS for further review at the time of interview.After 10 days,they sent me a 221g-White Form with my original certificates through courier.

Chennai Consulte sent my papers to USCIS on 1st feb,2007 for further review.

USCIS sent my case to VERMONT SERVICE CENTRE for review on 1st June,2007.

VERMONT SERVICE CENTRE sent my case to Department Of State for Visa Processing on 6th June,2007

Today,i got mail from USCIS like

Application Type: I129 , PETITION FOR A NONIMMIGRANT WORKER

Current Status: Case was shipped to the Department of State for visa
processing.

On June 6, 2007, we shipped this approved or re-affirmed case to the
Department of State for visa processing. For more information, please
contact them directly.

If you have questions or concerns about your application or the case
status results listed above, or if you have not received a decision from
USCIS within the current processing time listed*, please contact USCIS
Customer Service at (800) 375-5283.

*Current processing times can be found on the USCIS website at
www.uscis.gov under Case Status and Processing Dates.
*** Please do not respond to this e-mail message.

Looks like your case was sent back to consulate for further processing. They might call you anytime. Please let us know when you hear from them

Here is what is happens when a petition is returned
221(g) is issued to beneficiary at conclusion of the interview stating
the application and/or petition is being returned to the United
States.
Petition is returned to the United States by the interviewing
consulate for "further review" in what is called a diplomatic pouch.
Returned petition is received by the NVC. It is reviewed and entered
into the fraud database by fraud management.
Returned petition is sent to the local service center where the
petition was originally filed.
Local service center receives returned petition.
Local service center who processed the original petition sends a
notice of receipt to the petitioner.
Local service center reviews the returned petition and consular
officer notes on the case.
Local service center then sends either a NOID (Notice of Intent to
Deny) or NOIR (Notice of Intent to Revoke) to the petitioner also
asking for more proof of the relationship, many cases have specific
consular objections to rebut.
Petitioner is given 30-60 days from date of NOIR/NOID (depending on
the service center) to respond with additional evidence of the
relationship or other specific evidence. The timeframe to respond will
be provided in the letter.
Local service center receives evidence...if in the timeframe given
(30-60 days) the case is reviewed and either reaffirmed or denied.
If the petition is denied the local service center sends the
petitioner an 'official' denial letter. This can be be appealed if the
denial letter states such.

If the petition is reaffirmed the local service center sends the
petitioner an official notice of reaffirmation.
Local service center sends the reaffirmed petition AND its evidence
provided in the rebuttal directly to the consulate along with a
recommendation to issue a visa.
Consulate notifies the beneficiary of a new interview date.
Beneficiary has interview for the reaffirmed petition and the visa is
either issued, or the case in placed in Administrative Processing
which after cleared a visa is issued, or worst case scenario it is
denied via 221(g) and returned again to the USCIS.

Can the Visa Consulate give any other reason - like: potential immigrant - to reject a H1 Visa or is it strictly 221g?

Or does it mean that if USCIS recommends (even after 221g), the Consulate is under obligation to issue a visa unless the consulate wants to issue a 221g again?

I got mail from USCIS (re-affirmed case was shipped to Department of State for visa processing) .This message was sent to Chennai consulate and asked them about my H1B VISA case status. They replied me like this,
------------------------------------------------------------------------
"Whenever you receive a hard copy of the reaffirmed petition, you may come to the consulate on any Tuesday, Wednesday and Thursday between 10am and 12 o'clock with your 221(g) letter, DS forms, passports and updated documents."

my question is what is the meaning of the hard copy of the reaffirmed petition?.please reply me about this message if you have any idea about it.

What is the probability of getting thru ?
What is the role of Employer ?
My Employer seems to be neglecting the case...in this senario what is the best solution ?

Murali/Simran pls help me out

In This case the Employer is not all that active....

What are the possibilities of getting the docs back to Indian Consulate

What are USCIS Expectations from the Employer ?

Can we follow up or it is not recommended to do so with USCIS ?

Simran/Murali and others pls help.

All,

This is what i learnt from the lawyer. The cases returned to USCIS will take good 1-2 years. Almost a year over for me. No updates so far.

My employer tried to sort through senator. Senator's office accepted the request and asked for all details. But, it is of lower priority. Might take them few months to follow through. I think, it is better to move forward with different H1 or different category of visa.

P.S: The comment i made is relavent to my case. Lot of with return to USCIS might get faster response. It is based on the type of the case. Mine is more of a employer issue, i think.

Hi,

In my case too, its been more than a year since the case has been sent back to USICS.....my employer too is very inactive and does not want to followup

Anyone has any experience that after more than a year or so USCIS cleared the pending file....

I am a new member in this community. I went through this thread and some of the other threads on the same topic... I basically DO NOT see a single post which confirms he/she got the visa after his/her case was returned to USCIS for further review.

Please let me know if there's anyone around whose Visa went through successfully after this long pain. Well .. my case is the same -

- Jan 08 : Went for interiew at chennai consulate and got 221G requesting to submit extra docs, which I submitted after around 20 days of it.

- Mar 08 : Got a blue 221G saying my case has been returned to USCIS for the further review.

- No further update after that. The current status shown on their website is -

Application Type: I129, PETITION FOR A NONIMMIGRANT WORKER

Current Status : This case has been received from the State Department with a request we review it.

On October 21, 2008, a USCIS office received this case from the State Department with a request that we review it. We will notify you when we complete our review, or if we need something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address. You can also receive automatic e-mail updates as we process your case. To receive e-mail updates, follow the link below to register.

Please advice.. Some people say the chances of getting visa once your case is returned back to USCIS is almost nil.
