View Full Version : Can I apply for a Visitors visa while there is an IR visa appl pending for me

Could someone please clarify my doubts.

My husband who is a US citizen has filed the I-130 petition for me in the US. I understand it takes a pretty long time. So I have 2 questions.

1. Any idea how these petitions are attended to - are they all put in one pile and then attended to on a first come first served basis or are they arranged according to the alien relatives country of residence? The reason I asked is that although I am an Indian citizen, I do not reside in India at the moment.

2. Is there any possibility of me applying for a visitor's visa to the US in my country of residence when there is a I-130 petition pending in my name?

I think you can, now since each case id different and based on so many other factors, your best course of action is to consult an immigration attorney , to discuss pros and cons.

Thank you for your reply.

I just wanted to tell you I did apply for a visitor's visa and got it though they did not give the usual 10 years multiple entry that is usually given to applicants in this country. I got a multiple entry 18 month visa. Along with the usual documents, I had to show them proof that I was returning to this country [we are not citizens of this country but my parents are permanent residents] - my father gave an undertaking that he will be fully responsible for my return. The consular officer said 18 months was enough for my IR visa application to be considered.

So I am traveling next week to the US for 3 weeks.

Just a follow up on my earlier message.......my I-130 has been approved.....even before they looked at my K-3 visa application [which would have been a disadvantage coz I'd have to go back to India for the visa issuance]. My husband has already received the DS-3032 and the Affidavit of Support bill.
