I-140 approved change the job within same company (EB3 INDIA)-Very very urgent

Dear sir,
My case perm labor approved and I-140 approved but I didn’t file my 485 because of PD not current.

I asked my company lawyer to move to other group with in same company but lawyer said because of labor special requirement I can’t move to other group even though with in same company.

I am not changing job tile (same as labor certification “programmer analyst”) only think is change the job description.


I asked my lawyer worst case if I wanted to move to other group within same company. They told me to withdraw my green card then move to other group (same company).

I got 3 year extension based on the I-140 approved. My question is if I withdraw my green card can I use those 3 years then I can go back to India? OR INS will cancel my h1b extension because that extension based on my green card process.

Please advice .

My understanding is, after getting a GC, u are suppose to join ur GC job. that's it. it has nothing to do ur current job profile or roles. As per the law, once a GC is approved, u must join ur GC job. Also if ur company keeps ur GC alive, u can even change ur company. its a H1 job. current job doesn't affect ur GC processing at all.
