View Full Version : Murali please advice!!!!!!!! Parents visa rejected twice, no clue on how to proceed?

My parents’ visitor visa was rejected twice at Chennai Consulate. My husband was the sponsor and we both are working. I have been working since Aug 2004. First time, the VO didn’t look at the sponsor documents and the reason was 214b. We reapplied for them again with a gap of two months. This time the VO looked at the sponsor documents and again the reason was 214b. The VO told my parents that the bank balance was not sufficient to support them. We showed an average balance of 10K. The current balance is 30K.

My questions are:
1. Do they usually look at the average balance or the current balance?
2. How much average balance is needed to sponsor my parents? (We recently bought a house and need to pay off mortgage. So we might not be able to show a very good balance in the future sponsorships)
3. Did we reapply too soon (2months gap)?
4. How much gap is good to sponsor them again?
5. Is it a good idea if I sponsor them instead of my husband?
6. How many W2s are needed if I sponsor them?
7. Do you think the reason is 214b or did they see any other reason for rejection because I have read that 10K is good to sponsor parents?
8. I have read that a senator letter would help in such cases. Do we need a senator letter?

We are so sad, the same with my parents as we didn’t expect this. I have a brother and sister (both married) in India. My father is into business.

I appreciate any input on this. Senior members (Murali), please advice. Thanks a lot in advance.

My mom too was rejected twice. I'm also in same situation. Answer to above question helps me too a lot. Please reply ASAP

First of all, let me tell you I am not new to the feeling that you may be having right now. Application for my parents has been rejected 3 times.

I guess 2 months is a bit short gap between 2 interviews. One thought process is that by what factor situation can change within 2 months and if the 2nd officer grants the visa, all he is doing is proving the first one wrong.

I know there might have been exceptions and I have no intention to discourage you. My suggestion would be to have atleast a gap of 4-6 months and do have a significant change is situation when it comes to supporting document. Example may be a new business, new house, wedding in the close family, etc. I know they are not easy ones.

To answer your aspecific questions:

1. Current balance will be more important as opposed to average balance. However, a recent big deposit to shoot up the current deposit will not look good.

2. About 15-20 K should be good enough.

3. Yes, I guess you applied too soon. Even I did the same thing once.

4. About 4-6 months

5. It should not matter who sponsors. The sponsoring person may be the one who can show more monthly income.

6. I always send 3 years of tax returns. I guess even 2 must be sufficient. Just one may not be good.

7. You may be right in that case. Although not verified, I feel they use 214 (b) for all kinds of reasons. Anyways, 214b has kind of wide coverage and can be fit for whole set of non-conformities.

8. Senator letter? I am not sure about that. Usually, Senator will not interfere or overrule consulate's decision.

That's all my opinion. I may be incorrect though. <Not a legal advice>
