I have a question regarding my US B2 visitors visa. I want to return to the US after my B2 visa expires but do not know how long I have to leave for in order to return. There must be a minimum leave period before returning?
I am currently a visitor in the United States from the United Kingdom. I am a citizen of the United Kingdom. I came here on a B2 visa that expired in February 2007; I applied for an extension using the I-539 form which was submitted in December 2006. I am due to hear the Bureaus decision shortly. I applied for another 6 months which, if granted, would expire at the end of August 2007. In order to comply with the visa restrictions on gainful employment, I have been participating in work trade schemes across the states as a means of travelling. I understand that the bureau will give me a new date on which to leave by, and I will return to England on or before that date. However, I have been invited back to the states on October 1st 2007 for a vacation and I do not know whether that is feasible. How long must I be out of the states in order to return? I intend to return in october on the visa waiver program with a return flight to England previously booked.
If there is no mimimum leave period could I leave the states in september and return in october? Or if there is say, a 3 month leave period, can I take this by leaving in june in order to return 3 months later in october, or will the leave period run from the date on the new I-94 i am due to receive shortly?
Many thanks - Ben
