View Full Version : Issue about already granted OCI prior to new rules

Hi All,
I had the same problem that some other people had. Namely the OCI was granted based on the old rules.(both parents are indian citizens). I have a upcomming trip in december and so decided to inquire at the san francisco consulate. I sent two emails, one to the OCI section and the other direct to the Vice Consul(Passport & Visa). Here are the replies I received from both as of 03/28/2007
1)Dear Sir,
Thank you for your interest in OCI scheme.
To answer your queries-
As of now children whose both parents are not foreign nationals, cannot get OCI. Those who got it by default, can use it for their travels/stay etc. We hear that there may be review of the decision, and all children could become eligible and those who got it already will also be covered in that.

2)Dear Sir/Madam,
Thanks for your mail.
this is a serious question, which i cannot reply straight.
we treat all OCI cards issued as valid till cancelled. we have not cancelled any of them and have requested the govt to review rules and amend it. so my instinct is that your childs OCI CARD is VALID despite the fact that both parents are Indians still.
Secondly, i have not reced any negative report from any body who travelled with OCI cards issued in such cass

That's a very good news. Thanks for sharing this. In fact, some of us are worried that we were not able to get the OCI.

Do you know if holding the OCI card is good enough to travel to India or do we need the 'U' visa stamped on the passport inorder to travel to India?

The question here would be how did u get the OCI card without the U visa stamp on the American passport. Recommend u get in touch with the indian consultate. I just travelled to india with the OCI for my child and there was no problem
