pre-conditions/docs for L1-H1 CoS

simran, pls tell whether u have come across anybody having gone through such a situation.

l1 petition approved in jan 2006.

applied for h1 in apr 2006

l1 visa stamped in delhi in may 2006

h1 petition approved in oct 2006

travelled to US on L1 in nov 2006

i had my h1 petition approved when i was in india in oct 2006. i travelled on l1 though i had approved h1 petition. now i want to transfer to h1. has anybody gone thru such a situation.

since i am doubtful of such a transfer hapening successfully, can i apply for a fresh H1 this year. if i can apply, i hope my last year's petition wont be cancelled. by oct 2007, can i have both approved petitions. shud i give my last year's h1 petition number to my new employer/consultant. if i give, i dont think he will file for new h1.

even if i dont give, uscis will know that i have a petition. will there be a problem when they come to know. will they cancel old h1 petition or will they refuse new h1.

first of all, don't make any claims, i don't think anyone have a unique situation, this must have happened to thousands.

In terms of USCIS, each petition is different, u can have any number of H1's and L1's.

u have to give a copy of ur last approval, sometimes in the forms u need to mention that do u have any other visa approvals and its details. If u don't mention then u r lying which will cause a denial.
Also in some situations, ur new company can use this H1 to get a new one as a non-exempt from new yr quota.
