This is my situation.
I am a recent H1-b working in the U.S.
My parents are both below 60 and want to come to the U.S to attend my graduation ceremoney on the 22nd of May 2004.
There visa got rejected for the first time today.
Reason: My dad submitted to them a leave not from his office for 4 months and he applied for a 6 month visa. My parents are aplnning to stay with me for some time. I didnt send an i-134 form as I thought that they would get a visa on the merit of the letter i got from the Univ saying I was graduating.
I am in a real big fix now. I dont know how to approch this situation.
Possible ideas.
Ask my dad to take a 1 month leave of abscense form his company and ask for a visa for 1 month.
Things that have changed since last application will be : I was planning to tour the coutry and stay with my son for sometime, now I will attend his grad ceremony and return only touring the northeast side of the coutry.
Does this make sense to do.??
Does anyone have any other better qualified idead??

Adding to the above question.
I want to know if I should use the i-134 form and sponsor my parents visit ? They have enough funds to show of and do not require sponsorship as such.
I am really confused at this point as to what approach I should take ?
The other issue is due to my low salary ( i just got an h1 3 months back) I dont want them to get rejected on that reason again.
Should I keep the i-134 out of this or should I sponsor my parents trip?
The second time what is the duration of the visa that they should apply for ?

I-134 is a a very important document, I am suprised how you did'nt send that. Even if your income is less it does'nt matter, you should send it. Your parents' financial assests can complement yours.

I understand what you are saying , but my scenario is different.
I could very well be a student who cannot support their parents financially , but their parents want to come for the graduation ceremony ? Will they not give my parents a visa then ?
How will they ever know if I am on a H-1 or not ??
Kindly advise...If i try to prepare all the i-134 documents I stand to lose some time thought I guess i have 20 days before they are going to go again for their second visit.
Please let me know what the right approach is. I can run around and get the i-134 docs ready if that seems like the best way to deal with this situation. I need some immediate assistance here.

No matter what you should send I-134. When an applicant enters the consulate they only ask for DS-156 , I-134 and Passport, nothing else. Even if you try to give them a ton of financial and other statements they don't take, so that shows how much importance they place on I-134.
In your letter to the consulate where you request them to give a visa to your parents mention that you just got a job on H-1 and hence the annual income on I-134 looks less. Send them copy of your paystubs to prove it.
Don't request a 6 month visa, thats a NO NO. Ask for only one month visa with graduation ceremony being the only reason and remaining few days for visint Notheast. After they come here you can get it extended.

I decided to go this way because my my friends parents got their visa this way without any support. Anyways I will follow this procedure this time and see things work out.
How am i supposed to mention or make my low salary(35k) not become by a negative aspect ?

Luck plays a big role in getting a visa. I have seen people with perfect documents and high sponsor salaries being rejected and some with less than perfect ones getting it. Atleast from our side we shuld make sure every document is present and more, then if it gets rejected we can blame it on luck and not ourselves.
$35K annual salary is sufficient for your parents' air-tickets and a month's stay at your place. Plus they have their own funds. Also you could show a saving of $3K for airtickets. Consul officers reject mostly if they have suspicion of "potential immigrant" rather than whether sponsor makes 35K or 350K. Good luck buddy!! Let me know if they got it second time. BTW, which consulate is it (not that it matters that much, just curious).

I cant blame anyone for this even thought I am really pissed off right now. I am just gonna go one more time with a 100% effort and see what happens.
