All,

I worked for a big company from India and came to US 3 years back on their H1 visa. After 3 years I have quit the job and joined another company after getting the H1 transfer(H1 to H1 tRANSFER). I submitted by resignation to the earlier company and gave 2 weeks of notice.

During H1 transfer my visa also got extended for 3 more years.

Now the earlier company said that I cannot resign from here so I need to pay money (some 10k usd) to give my Experience letter.

My earleir I-94 expired and I need to go for re-validation soon as I need to go to India for some very important religious functions.Everybody inculding attorney advised me to go for stamping in Canada, I have an appointment at Canada in February.

I have complete paystubs for the last 3 years , offer letters from all my employers, the Old H1-B (I-797) from my earlier employer, Customer reference letter from the customer I worked for , when I was in earlier company.

I also did not get the W2 for the year 2006 till today (as it was supposed to be posted in the website).

How big is the risk in going for a visa without w2?Also,how big is the risk when you have such problem with an employer to get a green card in US

Pls help.

Forget payment. You will hardly need experience letter in future. Why paying 10k for it? The best documents that demonstrate your experince are your previous and current H1 documents (I-129 applications and LCA). You don't need anything beyond that.

You can report to IRS if you don't get your W2 within 31st Jan. Employer must give your W2 and that's the law.

No risk at all. Take last years 2005 W2 and recent 4-5 paystubs.

Unless you were out-of-status or violated immigration laws, there won't be any problem from your side. Having said that, conforming to immigration laws by you is only half of GC process. Your GC sponsor must be "fit" for sponsoring GC. In most of the cases GC is denied not because the beneficiary (employee) did something wrong, but employer did not do a good job. That's why it's very important to find a good sponsor to get GC.

As you said I have earlier H1B and current H1B nad paystubs as well..
