fresh H1 filing for OCT

I came to US on B1 and extended my stay by 3 months so the total stay on my B1 would be 6 months as of july 23rd. 2004.

Meanwhile a company is interested in filing for my H1, can I go ahead and apply for an H1 while I am on B1 in US, and once I get the H1 papers do you foresee any problems in getting the H1 stamped (oct 04) back in india when I go back.

since I would have stayed 6 months on B1 and before Oct I just have 2 months, I am sure my stay on B1 is not considered over stay, but will there be any questions asked about my stay on B1, What docs do I need to collect before I got for stamping in Oct.

changing the status in USA from B1 to H1 is OK and there should not be any problem.
I dont see any problem in getting stamp in India , but one thing is sure you should be ready to face some tough question related to your B1 ext etc ( I guess you have B1 ext approved?)
