View Full Version : B2 Visa and I-94 Date : URGENT

My MIL came today(23rd Dec 2006) at JFK, she holds B2-VISA for 10 years with multiple entries.
Her I-94 has expiry date as Jan 22 2007 and Valid Until B2.

She will be staying with us for 5 months, I know B2 is legally valid for 6 months, but does this date mentioned on I-94(01/22/07 OR Until B2 Valid ) will cause any issues while returning to home country OR re-entry in future.

I need urgent help on this.

Any valuable help/info will be appreciated..

Her B2 status is legal upto 01/22/07. She needs to leave USA within that date.

Can i file extension for this? Form I-539. And is there any online site where I can submit I-539?

Yes, you can file for extension by filing I-539 with valid reason (e.g. medical or accident). Keep in mind that B2 visa is only for tourism and social purpose. Therefore, "I want my mom to stay here for little bit longer" may not be valid reason. In addition, extension without good reason can create trouble for future visits (because POE officer may consider her as potential immigrant).

From where should i download I-539?
www.USCIS.gov is not working... I m getting tech. problem downloading it.
If any one has blank copy of I -539. please attach to this post.

Hi ,Did they ask any specific question from your MIL at port of entry ? I have heard a lot of these uncertainities at JFK . Generally its recommeded dont mention that one has come to see their grand child or delivery purposes
also i just had a friend who got his I 94 extended here from DHS office by visiting personally but his was H1 class ,not sure if that will work out for B1/B2 class

They didn't asked anything to her. And they just stamped 22/jan..
I m planning to visit near by international airport and meet with immegeration officers to consult on this issues. If they change it then it's fine ELSE I have to file I-539 (extension)..
