Parents visa when H1b holder is still in India

Hi

I have got my H1B visa last month. I am still in India and planning to go to US by 1st week of December 2006. My wife is pregnent and she will be coming to US in the month of Jan or Feb. I want my parents to join me to take are of my wife before and during pregnency.

Question.

1. Can my parents apply for dependent visa now when I am in India?. Is it a dependent visa or visitor visa(B2)?

if they cannot apply now, when I am in India

2. After how many months they can apply for dependent visa after me going to US.
3. How many months payslip(US payslsip) they need to go for visa stamping?.
4. How many months of bank statement needed?.

Parent are not eligible for dependent visa (H4). They can apply for visitors visa.

You cannot sponsor visitor visa from India. You have to in USA. Of course, they can apply for visitors visa in their own, provided they have enough financial ability to travel USA.



2. After how many months they can apply for dependent visa after me going to US.

They cannnot apply for dependent visa. They can only apply for visitor visa. There is no specific timeframe for sponsoring visitors visa. However, applying too early has two obstrucles:

1. You won't have enough savings to sponsor (unless you can bring enough savings from India).
2. It may raise visa officer eyebrow. He may wonder what is the reason you are trying to have your parents visit you so soon - immediately after arriving USA on H1.



3. How many months payslip(US payslsip) they need to go for visa stamping?.

Normally 1-2 months is good enough.



4. How many months of bank statement needed?.

Normaly 1-2 months.

Thanks a lot for information.

I have a cousin brother who is working in USA for 6 yrs. Can he sponser for my parents. In the pretext of going to visit him, my parents can come and join me. Can that be done. If so, do we need to show the proof any relationship with him.
